Notice of Privacy Practices
Your Health Information and Your Rights Over It
Required by the federal privacy rule under HIPAA. It explains how the practice may use and share your health information, and what you can require of us.
The Notice
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
This notice applies to the health information created and kept by Strength Works PT in the course of providing you with physical therapy.
The law requires us to keep your health information private, to give you this notice describing our legal duties and privacy practices, and to follow the terms of the notice currently in effect.
How We May Use and Share Your Health Information Without Asking You First
In the following situations we may use or disclose your health information without asking for your written permission.
- Treatment
- To provide and coordinate your care. This includes discussing your condition and progress with your physician or surgeon, with a specialist you have been referred to, or with another therapist who takes over your care, and reviewing records sent to us about you.
- Payment
- To bill and be paid for your care. This includes sending a claim to a health plan, confirming what a plan will cover before care begins, and responding to a plan's questions about a claim. If you pay for your care yourself and in full, see your right to restrict disclosure below.
- Health care operations
- To run the practice — reviewing the quality of care, training, arranging for legal and accounting services, and general administration.
- Appointment reminders and follow-up
- To contact you about an appointment, or to follow up after a visit. You may tell us how you prefer to be contacted, and we will accommodate a reasonable request.
- People involved in your care
- To a family member, friend or other person you identify as involved in your care or in paying for it, limited to the information relevant to their involvement. If you are present and able to say, we will ask you first.
Other Uses and Disclosures Permitted or Required by Law
We may use or share your health information without your permission in these further circumstances, each of which is limited by law to what that law requires or allows:
- When federal, state or local law requires the disclosure.
- For public health activities — reporting disease, injury, a birth or a death, or a problem with a medical product.
- To report suspected abuse, neglect or domestic violence to the authority permitted to receive it.
- To a health oversight agency for audits, investigations, inspections and licensure.
- In response to a court or administrative order, and to a subpoena or discovery request where the law's notice and protection requirements have been met.
- To law enforcement in the limited circumstances the privacy rule permits.
- To a coroner, medical examiner or funeral director as necessary for them to carry out their duties.
- For organ, eye or tissue donation.
- For research, where an institutional review board has approved the use and the required privacy protections are in place.
- To prevent a serious and imminent threat to the health or safety of you or another person.
- For specialised government functions, including military and veterans' activities, national security, and protective services.
- As authorized by, and to the extent necessary to comply with, workers' compensation law.
Uses That Always Require Your Written Permission
We will not do any of the following without your written authorization:
- Use or share psychotherapy notes, except in the narrow circumstances the law allows.
- Use or share your information for marketing purposes.
- Sell your health information.
- Any other use or disclosure not described in this notice.
If you give written authorization, you may revoke it at any time, in writing. Revoking it stops any further use or disclosure under that authorization, but cannot undo a disclosure we already made while it was in effect.
Your Rights Over Your Health Information
- Get a copy of your record
- You may inspect and obtain a copy of the health information we hold about you, in paper or electronic form. Ask us and we will provide it, usually within 30 days. We may charge a reasonable, cost-based fee for copying.
- Ask us to correct your record
- If you believe something in your record is wrong or incomplete, you may ask us in writing to amend it. We may decline, and if we do we will tell you why in writing and you may file a statement of disagreement to be kept with the record.
- Get a list of disclosures
- You may ask for an accounting of certain disclosures we made of your health information in the six years before your request. Disclosures for treatment, payment and health care operations, and those you authorized, are not included in that list.
- Ask us to limit what we use or share
- You may ask us to restrict a use or disclosure. We are not required to agree, with one exception: if you pay in full, out of pocket, for a service, you may require us not to disclose information about that service to your health plan, and we must comply unless the law requires the disclosure.
- Ask us to contact you differently
- You may ask us to reach you at a particular number or address, or by a particular means. We will accommodate reasonable requests and will not ask you why.
- Get a paper copy of this notice
- You may ask for a paper copy at any time, even if you agreed to receive it electronically. Ask and we will give you one.
- Be told if your information is breached
- If your unsecured health information is breached, we will notify you as the law requires.
- Choose someone to act for you
- If you have given someone medical power of attorney, or if someone is your legal guardian, that person can exercise these rights and make choices about your information. We will confirm their authority before acting.
Our Duties
We are required by law to maintain the privacy and security of your protected health information, to notify you if a breach affects it, to follow the terms of the notice currently in effect, and not to use or share your information other than as described here unless you tell us in writing that we may.
We reserve the right to change this notice, and to make the revised notice apply to information we already hold as well as to information we receive in future. If we make a material change, the revised notice will be posted on this page and a copy will be available at the practice.
Information You Send Through the Website
There is no contact form on this website. To reach the practice you call or send an email, so nothing you write passes through this site at all.
If you do send medical detail by email or say it on the telephone, it is treated as protected health information from the moment it reaches us, and everything in this notice applies to it.
The only outside company that learns anything about your visit to this website is Google Analytics, which is told which pages were opened and nothing else. It is never told your name, what you asked about, or whether you became a patient. How the site's single cookie works is set out in the Privacy Policy.
Complaints
If you believe your privacy rights have been violated, you may complain to the practice using the contact details below, and you may complain to the federal government.
